1. Agreement to these terms
These Terms of Use (“Terms”) are a binding agreement between you and Echo Harbor Tech, LLC (“Echo Harbor,” “we,” “us,” or “our”), a New Mexico limited liability company. They govern your use of our website at echoharbor.tech and our portfolio of applications, publications, and tools: WikiClip (wikiclip.com), AIthinks (aithinks.com), Echo Harbor News (echoharbor.news), and Echo Harbor Press (echoharbor.press) (together, the “Services”).
By accessing or using any of the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services. Individual products may present supplemental terms; where they do, the supplemental terms control for that product.
2. Eligibility
You must be at least 13 years old (or the age of digital consent in your jurisdiction, if higher) to use the Services. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization, and “you” refers to both you and the organization.
3. The Services
Our products are in active development, and several are available only to small groups of early users. Features may change, be suspended, or be discontinued at any time as the portfolio evolves. We will be thoughtful about changes that affect your saved content, but we cannot guarantee that any particular feature will remain available.
4. Accounts
Some Services require an account. When you create one, you agree to provide accurate information, keep your credentials confidential, and notify us promptly of any unauthorized use. You are responsible for activity that occurs under your account.
5. Acceptable use
When using the Services, you agree not to:
- Violate any applicable law or regulation, or infringe anyone's rights.
- Upload or transmit content that is unlawful, harassing, defamatory, or malicious (including malware).
- Interfere with or disrupt the Services, probe or circumvent security measures, or access systems or data you are not authorized to access.
- Scrape, harvest, or bulk-download content or data from the Services except as permitted by a documented API or with our written consent.
- Use AI features to generate content that is unlawful, deceptive, or intended to harm others, or misrepresent AI-generated output as human-authored where that matters.
- Reverse engineer, decompile, or disassemble any part of the Services except where that restriction is prohibited by law.
- Resell, sublicense, or commercially exploit the Services without our written consent.
6. Your content
Content you create or save in the Services — clips, notes, prompts, messages, reading lists — remains yours. You grant us a limited, non-exclusive license to host, store, process, and display that content solely as needed to operate and improve the Services. You represent that you have the rights necessary to submit the content you submit.
We do not claim ownership of your content, we do not sell it, and we do not use it to train AI models.
7. AI-generated content
Some Services, including WikiClip and AIthinks, produce AI-assisted output. AI output can be incomplete, out of date, or simply wrong — even when it is presented with confidence and shown alongside its reasoning. You are responsible for verifying output before relying on it. AI output is not professional advice: nothing the Services generate should be treated as legal, medical, financial, or other professional counsel. Depending on your settings and consent, AI features are powered either by external AI providers (OpenAI, Anthropic, or Google) or by Echo Harbor's on-premise model; how each option handles your content is described in our Privacy Policy.
8. Our intellectual property
The Services — including software, design, trademarks, and the editorial content published by Echo Harbor News and Echo Harbor Press — are owned by Echo Harbor or its licensors and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial purposes. You may quote our editorial work with attribution; you may not republish substantial portions without written permission.
9. Feedback
We genuinely read every message. If you send us ideas, suggestions, or feedback, you agree that we may use them to improve the Services without restriction or obligation to you.
10. Third-party services
The Services may link to or interoperate with third-party websites and services. We do not control them and are not responsible for their content, policies, or practices. Your use of a third-party service is governed by its own terms.
11. Paid services
If we introduce paid subscriptions or purchases, pricing, billing, and refund terms will be presented clearly before you pay, and those terms will supplement this agreement. We will not enroll you in a paid service without your explicit consent.
12. Disclaimers
The Services are provided “as is” and “as available.” To the fullest extent permitted by law, Echo Harbor disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that content (including AI output and editorial content) is accurate or complete.
13. Limitation of liability
To the fullest extent permitted by law, Echo Harbor and its members, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from or related to your use of the Services. Our total liability for all claims relating to the Services will not exceed the greater of one hundred U.S. dollars ($100) or the amounts you paid us for the Services in the twelve months before the claim arose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
14. Indemnification
You agree to indemnify and hold harmless Echo Harbor from claims, damages, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Services, or your violation of these Terms or applicable law.
15. Termination
You may stop using the Services at any time, and you may ask us to delete your account and data as described in our Privacy Policy. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue a Service. Sections that by their nature should survive termination — including 6 through 14 and 16 — survive.
16. Governing law
These Terms are governed by the laws of the State of New Mexico, without regard to its conflict-of-laws rules. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Bernalillo County, New Mexico, and you consent to their jurisdiction. Before filing a claim, please contact us — most concerns can be resolved with a conversation.
17. Changes to these terms
We may revise these Terms from time to time. When we do, we will post the revised version here and update the effective date above. If a change is material, we will make that clear on our website or, where appropriate, notify you directly. Continued use of the Services after a change takes effect constitutes acceptance of the revised Terms.
18. Miscellaneous
These Terms, together with the Privacy Policy and any supplemental product terms, are the entire agreement between you and Echo Harbor regarding the Services. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
